Near Delight – Terms of Use

By accessing or using the Near Delight platform, you agree to these Terms.

1. Platform Role

Near Delight is a technology platform connecting:

  • Customers
  • Restaurants
  • Delivery partners

Near Delight does not prepare food.
Restaurants are responsible for food quality and safety.

2. User Eligibility

Users must:

  • Be at least 18 years old
  • Provide accurate information
  • Use the platform lawfully

3. Pricing Transparency

Near Delight follows a Zero Commission Model where:

  • Restaurants list their actual menu price
  • Near Delight may charge:
    • Handling fee
    • Payment gateway charge
    • Delivery fee

Prices may vary by restaurant.

4. Orders & Payments

Users must pay the full amount displayed at checkout.

Payments may be processed through:

  • UPI
  • Credit/debit cards
  • Wallets

Refunds will be processed based on investigation.

5. Refund & Complaint Policy

Refunds may be issued in cases such as:

  • Missing items
  • Incorrect items
  • Delivery failure
  • Severe quality issues

Users may be required to submit:

  • Photos
  • Order details

False complaints may lead to account suspension.

6. Prohibited Activities

Users must not:

  • Submit false complaints
  • Abuse delivery partners
  • Misuse promotions
  • Attempt fraud
  • Upload misleading or manipulated images
  • Use AI-generated or edited images to falsely claim refunds
  • Manipulate order data
  • Attempt unauthorized system access

Near Delight reserves the right to:

  • Cancel orders
  • Block accounts
  • Pursue legal action

7. Intellectual Property

All trademarks, logos, designs, and platform content belong to Sabhyasha Retail Tech Pvt. Ltd. Unauthorized use is prohibited.

8. Limitation of Liability

Near Delight is not liable for:

  • Food quality issues originating from restaurants
  • Delays due to traffic or weather
  • Third-party payment failures

9. Termination

Near Delight may suspend or terminate accounts for:

  • Fraud
  • Policy violations
  • Abuse of services

10. Governing Law

These terms are governed by Indian law.
Jurisdiction: Courts of Bhubaneswar, Odisha.
